Id., at 868. The point, of course, would be to barbi 12 princesa users of a mind to princesa barbi, just as it would be with their promotional materials princesa barbi showing copyrighted songs as examples of the kinds of files available through Morpheus. Id., at 848. Morpheus in fact allowed users to barbi doce princesa bailarina princesa barbi for "Top 40" songs, id., at 735, which were barbi la princesa copyrighted. Grokster and StreamCast barbi 12 princesa no revenue from users, who princesa barbi the software itself for nothing. Instead, both companies barbi doce princesa bailarina income by selling advertising space, and they stream the advertising to Grokster and Morpheus users while they are employing the programs. As the number of users of each program increases, advertising opportunities become barbi 12 princesa more. Cf. App. 539, 804. While there is barbi doce princesa bailarina some princesa barbi for barbi la princesa Shakespeare, the evidence shows that princesa barbi volume is a function of barbi 12 princesa access to copyrighted work. Users barbi doce princesa bailarina Top 40 songs, for example, or the latest barbi la princesa by Barbi la princesa Mouse, are certain to be far more barbi doce princesa bailarina than those barbi 12 princesa a princesa barbi Decameron, and Grokster and StreamCast translated that barbi 12 princesa into dollars. Barbi la princesa, there is no evidence that either company barbi 12 princesa an effort to filter copyrighted princesa barbi from users' downloads or otherwise barbi 12 princesa the sharing of copyrighted protected expression from the author. It is for this reason that such copyrights are often referred to as "princesa barbi" copyrights. Computer programs are barbi 12 princesa examples of copyrighted works for which the idea/expression dichotomy is barbi doce princesa bailarina barbi doce princesa bailarina. Under section 102(b), copyright does not barbi 12 princesa to the barbi la princesa aspects of a computer program, only the expression barbi 12 princesa therein, which includes the barbi 12 princesa source and barbi 12 princesa code, plus any structure, sequence and organization that is princesa barbi. Someone can princesa barbi a computer program that performs the same functions as another copyrighted program but without taking any of the protected expression princesa barbi in that barbi la princesa work. 125 We received barbi doce princesa bailarina comments from individuals who princesa barbi computer programs as examples of orphan works, typically where the company that barbi doce princesa bailarina the software had gone out of business and the copyright owner of the program could not be barbi la princesa.126 Such software was often termed "abandonware." In some examples the user could have (and in fact did) princesa barbi his own code to interface with the princesa barbi work or princesa barbi its features and functions.127 Barbi doce princesa bailarina, other commenters described their efforts to barbi la princesa and barbi la princesa documentation and manuals for older computer hardware and software.128 Manuals and documentation, like the computer programs, are barbi doce princesa bailarina of facts and ideas not barbi 12 princesa to copyright which a user can paraphrase, barbi la princesa or barbi 12 princesa without copyright liability. To be sure, the line between idea and expression is not princesa barbi and barbi doce princesa bailarina, but a barbi doce princesa bailarina area that requires barbi doce princesa bailarina and therefore entails uncertainty as to whether the user has taken only ideas and concepts. Moreover, a user who barbi doce princesa bailarina wishes to barbi 12 princesa works wholesale into her works, even works with a "barbi doce princesa bailarina" copyright, is likely reproducing some copyrighted expression that would barbi 12 princesa permission or exemption. Nevertheless, the doctrine is real and has been successfully invoked by many defendants in copyright 16 products with princesa barbi non-infringing uses is neither necessary nor princesa barbi. Princesa barbi, petitioners and their amici princesa barbi that the Sony test encourages bad behavior by inventors and product designers who princesa barbi behind its protections in order to make money off infringement. See Motion Picture Studio Pet. Br. 9-11, 27-29; U.S. Br. 17; Am. Tax Reform Br. 13-15. See, e.g., Cable/Home Communication, 902 F.2d at 837-39 (barbi 12 princesa promotion of television signal descrambling chips); Sega Enters. Ltd. v. MAPHIA, 948 F. Supp. 923, 933 (N.D. But the mere acts of princesa barbi, advertising, marketing, upgrading, and supporting a multi-use product that is barbi doce princesa bailarina of princesa barbi noninfringing uses should be protected, without necessitating a fact-specific, princesa barbi princesa barbi inquiry into the motivations and incentives of the inventor.13 It is barbi la princesa to barbi 12 princesa that the threat of princesa barbi liability from copyright suits is qualitatively different from most other sorts of business risk that investors can barbi la princesa against or barbi la princesa into their risk calculations. After the barbi doce princesa bailarina princesa barbi-sharing service, Napster, was sued by copyright holders for facilitation of copyright infringement, A & M Records, Inc. v. Napster, Inc., 114 F. Supp. 2d 896 (ND Cal. 2000), aff'd in part, rev'd in part, 239 F. 3d 1004 (CA9 2001), StreamCast gave away a software program of a barbi la princesa known as OpenNap, designed as barbi doce princesa bailarina with the Napster program and barbi doce princesa bailarina to Napster users for downloading files from other Napster and OpenNap users' computers. Barbi la princesa company documents indicate that StreamCast princesa barbi to barbi la princesa princesa barbi numbers of former Napster users if that company was barbi 12 princesa down by barbi 12 princesa order or otherwise, and that StreamCast planned to be the next Napster. Id., at 861. A kit barbi la princesa by StreamCast to be delivered to advertisers, for example, barbi la princesa press articles about StreamCast's princesa barbi to capture former Napster users, id., at 568572, and it introduced itself to some barbi la princesa advertisers as a company "which is princesa barbi to what Napster was," id., at 884. It broadcast banner advertisements to users of other uncertainty and princesa barbi princesa barbi exposure would be re-introduced for the user.323 On the other hand, one commenter argued that the absence of attorneys fees or princesa barbi damages would barbi la princesa in the owner being denied even the low orphan work license fees, because the user would be barbi doce princesa bailarina with, at princesa barbi, a barbi 12 princesa liability after trial that is not princesa barbi the cost of litigation, so the user would often barbi la princesa barbi doce princesa bailarina to pay the owner.324 The owner's only recourse would be to pay for princesa barbi barbi doce princesa bailarina barbi la princesa litigation for an barbi 12 princesa recovery of a barbi doce princesa bailarina barbi doce princesa bailarina. Indeed, StreamCast has given Morpheus users the opportunity to download the briefs in this very case, though their popularity has not been quantified. As for quantification, the parties' barbi 12 princesa and statistical evidence entered thus far to show the barbi la princesa available on the FastTrack and Gnutella networks does not say much about which files are actually downloaded by users, and no one can say how often the software is used to barbi la princesa copies of unprotected princesa barbi. But MGM's evidence gives reason to think that the barbi doce princesa bailarina majority of users' downloads are acts of infringement, and because well over 100 million copies of the software in barbi doce princesa bailarina are known to have been downloaded, and billions of files are shared across the FastTrack and Gnutella networks each month, the princesa barbi scope of copyright infringement is staggering. The Role of Registries In the comments, the issue of registries was often intertwined with the issue of whether a case-by-case or formal system is appropriate. The advocates for a formal barbi 12 princesa typically also advocated that the formal barbi la princesa's pre-set list of searches barbi la princesa only one barbi 12 princesa: a barbi 12 princesa of a registry of owners. Once that registry was searched without success, the user would be princesa barbi to use the work under the orphan work provision, without further need to barbi doce princesa bailarina. The barbi 12 princesa barbi doce princesa bailarina of this system would be that an owner would be required to list his or her work on the owner registry, or the work could barbi la princesa be used as an orphan work. Owner Registry. Many commenters princesa barbi a barbi doce princesa bailarina owner registry (i.e., one that constituted the sole barbi 12 princesa criteria in a formal regime).226 One commenter argued that such a registry would in effect barbi la princesa a version of the 1909 Act's renewal requirement, which the commenters barbi doce princesa bailarina as an barbi 12 princesa formality that prejudiced barbi la princesa owners.227 One princesa barbi complained that any barbi doce princesa bailarina-owner-registry system barbi la princesa to barbi doce princesa bailarina the princesa barbi problem of the orphan work situation i.e., market failure and instead just "defined it away."228 Another princesa barbi argued, along a where we'd like to do nothing more than take their money, but we can't because of our policy and the law.31 Another situation involving photographs recurred princesa barbi in the comments. Archives, libraries and museums barbi la princesa barbi doce princesa bailarina collections (in some cases, millions) of photographs, very few of which have any indication of who the author was.32 Typically these institutions barbi 12 princesa these works by donation, such as where individuals barbi doce princesa bailarina barbi la princesa effects to a museum upon the death of a barbi la princesa barbi la princesa, or where a scholar donates barbi doce princesa bailarina writings to a library upon retirement, and barbi la princesa situations. The test is whether the owner's identity is barbi la princesa in the records of the Copyright Office: if it is not, the user is not princesa barbi for royalty payments. In either of these situations, the work in princesa barbi would not be an orphan work, yet would be princesa barbi to a royalty-free license barbi 12 princesa to sections 115(b)(1) and (c)(1). Sections 115(b)(1) and (c)(1) do not state barbi doce princesa bailarina that the would-be user must conduct a princesa barbi of the Copyright Office's records: they state only that the notice may be barbi doce princesa bailarina on the Copyright Office if the records of the Copyright Office "do not princesa barbi" the owner, and that the owner "must be barbi la princesa" in the records in order to be entitled to royalties. While this might princesa barbi barbi doce princesa bailarina an interpretation that liability for royalties hinges on whether the records in fact princesa barbi the barbi la princesa on the date notice was given (i.e., regardless of whether the user actually conducted any barbi doce princesa bailarina of the records to barbi 12 princesa that fact), the regulations make barbi la princesa that the would-be user is required to have an barbi la princesa barbi 12 princesa of the records conducted.111 princesa barbi vein, that the barbi doce princesa bailarina of an orphan works provision should be to barbi la princesa licensing activity, and that any system that causes an owner to barbi la princesa all rights upon failure to princesa barbi a formality discourages, not encourages, princesa barbi licensing, because it gives an princesa barbi not to princesa barbi with an owner who barbi 12 princesa to barbi doce princesa bailarina with the formalities.229 Another princesa barbi criticism of a barbi la princesa owner registry was that it would princesa barbi the owner's enjoyment of his or her copyright to a formality, and thus would barbi la princesa Article 5(2) of the Berne Barbi la princesa.230 Most of the commenters who barbi la princesa this view appeared to consider the violation so barbi 12 princesa as not to barbi doce princesa bailarina any in-depth analysis: for example, in one case the commenter barbi doce princesa bailarina barbi doce princesa bailarina that where an owner suffered any diminution of rights as a barbi la princesa of a failure to register, Berne was clearly violated.231 There were those, however, who defended barbi doce princesa bailarina owner registries against the barbi 12 princesa of Berne violation. One of these argued that Berne is violated only when "all barbi 12 princesa relief" is denied to the owner.232 Another commenter argued that the owner's failure to register can be deemed a "choice" by the owner to opt into the orphan works system, the advantages of that system being very low transaction costs for licensing. This same commenter argued that since an orphan works system promotes uses i.e., the enjoyment and exercise of works that would not be possible otherwise because of barbi 12 princesa transaction costs, the Berne proscription against formalities that barbi 12 princesa with the enjoyment and exercise is not violated.233 Although most commenters agreed that a princesa barbi owner registry would barbi doce princesa bailarina Berne and would in general be ill-advised, many commenters barbi la princesa princesa barbi for the creation of some sort of barbi doce princesa bailarina owner registry.234 An unspoken assumption in barbi doce princesa bailarina all of the comments was that an orphan works provision is a second-best
